Team member privacy notice

HealthEquity, Inc. and its subsidiaries, including WageWorks, Inc. and Fort Effect Corp. (DBA Luum), prioritize your privacy. This notice explains who we are, how and why we handle your personal information as your employer, and your rights regarding that information.

In this notice, when we say "HealthEquity," "the Company," "we," "our," or "us," we are referring to HealthEquity, Inc. and its subsidiaries. When we say "team member," "you," or "your," we are referring to current, former, and prospective employees, contractors, and other workers.

Personal Information We Collect About You

The Company may collect and use personal information that can identify, relate to, describe, or be reasonably associated with team members. Sensitive Personal Information is a subset of personal information and may include, but is not limited to, Social Security numbers, financial account information, health information, and demographic information.

Below are the categories of personal information we may collect:

  • Identifiers — name, contact details, Social Security Number, government IDs
  • Demographic information — age, gender, ethnicity (voluntarily provided)
  • Protected classification characteristics
  • Background information — education, certifications, employment history
  • Employment and professional information — role, performance, compensation
  • Financial information — bank account, tax forms, benefits elections
  • Health information — benefits enrollment, accommodations, leave records
  • Spouse and dependent information — for benefits administration
  • Workplace, device, and usage information — IT systems, badge access, device identifiers
  • Video, voice, and image data — security cameras, recorded meetings, profile photos

How Your Personal Information is Collected

We collect information directly from you during the hiring process and throughout your employment. We may also collect information from third parties such as LinkedIn, background check providers, and former employers. Additional information is collected automatically through IT monitoring, data loss prevention tools, and cookies.

How and Why We Use Your Personal Information

We use your information for legitimate business purposes including payroll and benefits administration, fraud prevention, background screening, regulatory compliance, policy adherence, operational purposes, and identity verification. We may use AI tools including Microsoft Copilot in accordance with our Responsible AI Policy.

Who We Share Your Personal Information With

We may share your information with our affiliates, service providers (such as ADP Vantage, SAP Concur, Motivosity (edit profile)), government agencies as required by law, and clients where necessary for service delivery.

How Long Your Personal Information Will Be Kept

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. For more details, see the Records Retention Policy.
